Terms of Service

1. Who we are and what these terms cover

WebOsHost is the provider named in your order, registered at Jan Altinkhof 31, 9646 DL Veendam, the Netherlands (KvK 42005368; VAT NL003073218B79). Contact us through info@weboshost.com, which opens our email contact form. These terms cover the WebOsHost website and the services identified in your order, including web hosting, VPS, reseller services, email, backups and domain services where purchased. Your order and the applicable product description specify your actual features, resources, duration and price. Product-specific terms and applicable domain-registry rules apply to the relevant product; if they conflict with these general terms, the more specific agreement applies only to that product. Mandatory consumer rights always prevail.

Beta phase

WebOsHost currently operates as a beta service. During the beta, hosting is provided free of charge to testers. Because the platform is still being tested and improved, interruptions, maintenance and changes may occur more often than on a mature service, and we do not yet guarantee 99.9% availability. Keep your own copy of important data. We will announce the end of the beta, the start of paid plans and the moment we guarantee 99.9% availability in advance; no charge applies to a tester's free hosting unless you explicitly order a paid service after that announcement.

2. Orders and your account

Before placing an order, you must be able to review its key features, the initial and renewal prices including applicable tax, billing cycle, cancellation conditions and these terms in a form you can save. We confirm receipt and acceptance of an order through the checkout and the contact details you supply. We may refuse an order for objective reasons, including fraud, inaccurate identity information, non-payment or a service we cannot lawfully provide, and explain this where permitted. Protect your account credentials and promptly report suspected unauthorized access. We remain responsible for security measures under our control.

3. Our duties and your duties

We provide the infrastructure and managed features included with the selected service, with reasonable care and appropriate security. You control the content you upload and the applications, passwords and settings you manage. Keep your own software current and make an independent copy of important data. This does not remove our responsibilities for backups, security or availability that we expressly offer, or your statutory rights. If we detect a service failure, we investigate it and communicate material incidents through the contact methods available to the account.

4. Acceptable use and protective action

You must not use the services for unlawful content or conduct, infringement of others' rights, phishing, malware, unauthorized access, spam, open mail relays, attacks on networks or users (including DDoS), or activity that materially disrupts shared resources. You must also comply with applicable registry and registrar policies for a domain. Resource restrictions, if any, must be disclosed in your product description rather than invented after purchase.

We may limit an affected service only where reasonably necessary to stop an immediate security threat, respond to a lawful order, protect others or address a material breach. When feasible we notify you, explain the specific reason and scope, and give you a practical opportunity to correct the issue and contest the decision. Urgent protective action may be taken before notice; we then provide information as soon as reasonably possible. Anyone can report illegal content or abuse using the public reporting form, including the URL and reason. We assess reports carefully and objectively, explain our decision and available review options where the Digital Services Act requires it. We provide a reachable contact point for users and competent authorities.

5. Prices, renewal and payment

The amount, billing interval, applicable VAT, introductory discount, renewal price and any separately priced domain or third-party charges are those displayed and confirmed before you pay. A "first month free" offer applies only to the products and periods explicitly shown at checkout. Price changes for an existing service are notified in advance, subject to applicable law and your right to cancel. We issue invoices and provide reasonable payment reminders before any proportionate suspension for non-payment. Any collection costs or interest must comply with law and be disclosed before they apply.

6. Withdrawal, cancellation and refunds

Consumers buying at a distance generally have a 14-day statutory right of withdrawal, subject to the rules and any lawful exceptions that apply to the particular service. Starting a service during that period does not by itself erase that right. We provide the required information and withdrawal process before checkout. You may cancel through the account or by contacting us. The effective date and any payment for service already supplied depend on your billing cycle and applicable law.

During the beta, testers' hosting is free, so there is no hosting payment to refund. Any paid item you order separately (for example a domain registration) is shown with its price before you pay, and your statutory rights apply to it. Any voluntary money-back guarantee for paid plans will be published with those plans after the beta. Nothing here reduces statutory withdrawal, refund or consumer-conformity rights.

7. Domains, data and backups

Domain registration, transfer and renewal depend on the rules and availability of the relevant registry and registrar; a search result is not a reservation. We explain any product-specific eligibility, charges and deadlines before the order. Backup frequency, scope, retention and restore options are those offered for your service. We take reasonable steps to operate the advertised backup feature, alert and investigate failures, and assist with recovery as agreed. A backup is not a promise that every file can always be restored; this does not waive remedies required for a failure of our own obligations.

When a hosting service ends, we arrange the stated data-export opportunity and grace period before purge, unless urgent legal or security reasons prevent this. Billing records and certain protected backups may remain for the periods explained in the privacy notice or required by law. Backup and deletion periods can differ by product; the features and retention stated in the order and privacy notice apply.

8. Availability and support

During the beta there is no guaranteed uptime and no service credits; we aim for 99.9% availability and work towards guaranteeing it. The SLA describes how we measure and report availability, and will state the guarantee once announced. "24/7 support" means the advertised contact channel is available for reporting incidents; it does not promise a one-hour resolution unless explicitly agreed. Maintenance affecting service is announced where reasonably possible. We distinguish the ability to report incidents at any time from staffed response hours.

Availability can be affected by events outside our reasonable control, including failures of third-party networks, upstream connectivity, domain registries or registrars, DNS providers, power, force majeure, attacks that exceed reasonable mitigation, and faults in customer-managed software. We are not responsible for downtime caused by such external events to the extent permitted by law. We still investigate, communicate material incidents where reasonably possible, and work to restore service as soon as reasonably possible. This does not limit liability that cannot lawfully be excluded.

9. Liability, changes and disputes

Each party remains liable as required by applicable law for breaches within its control. For business customers, any agreed limits on indirect commercial loss or overall liability must be reasonable, specific and disclosed in the product agreement. Nothing here excludes liability that cannot lawfully be excluded, including mandatory consumer remedies or damage caused intentionally or by gross negligence. We give reasonable advance notice of material contract changes and explain any right to object or cancel.

Please first raise a complaint through the info@weboshost.com contact form or by post to Jan Altinkhof 31, 9646 DL Veendam, the Netherlands. Dutch law applies, without depriving a consumer of mandatory protections of their country of residence. The competent court or other dispute process is determined by applicable law, not by a blanket waiver of consumer rights.
